1. Acceptance and eligibility
By downloading, accessing, or using Histrail, you agree to these Terms with Oleksandr Shevchenko. You must be legally able to accept these Terms. If local law requires authorization from a parent or guardian, you may use Histrail only with that authorization.
2. The Histrail service
Histrail is a bilingual historical travel passport for browsing curated collections, understanding real places, recording visits, saving places, tracking progress, and using supported sharing. Public catalog browsing does not require an account; account-backed mechanics do.
3. Accounts and sign-in
Provide accurate account information and protect your credentials. Email sign-in is implemented; Apple and Google sign-in appear only when configured. You are responsible for activity performed through your account until you report unauthorized access.
4. Historical and informational content
Histrail aims for responsible, sourced editorial context, but historical interpretation, dating, attribution, site conditions, opening information, and third-party material may be incomplete or change. Reconstruction, memory, surviving fabric, and uncertainty should be read as labeled. Histrail is not a substitute for professional historical, legal, safety, or travel advice.
5. Real-world travel and safety
You decide whether, when, and how to visit a place. Observe laws, closures, property boundaries, accessibility conditions, weather, conflict and emergency guidance, and instructions from site operators. Do not use Histrail while driving or in a way that distracts you from your surroundings.
6. Visits, photos, notes, and user content
You keep ownership of your photos and notes. You permit Histrail to host, transform, transmit, and display them only as needed to provide the service to you. Photos are optional. Do not upload unlawful material or content you lack permission to use. This permission does not grant Histrail the right to use your private photos or notes in advertising or marketing.
7. Progress and optional verification
A VISITED record completes a required place for progress. Photo verification is optional and does not gate completion. GPS and EXIF are supporting metadata, not proof, and old or manual trips are first-class.
8. Public sharing
You choose when to create supported collection or completion links. Public output is limited to designated achievement fields and excludes email, notes, visit photos, coordinates, exact visit dates, and saved places. Revoke links when the product offers that control.
9. Free access and Premium
Seven complete collections and their mechanics are currently free. Premium unlocks access to all current and future historical collections; it does not sell a separate feature bundle. Catalog composition may evolve without deleting your account-backed travel record.
10. Store subscriptions
Premium is purchased through the Apple App Store or Google Play using the plan, localized price, billing period, tax, renewal terms, and any offer shown before purchase. No website checkout is offered. Subscriptions renew automatically until canceled through the applicable store. Histrail supports restoring eligible purchases and synchronizes verified entitlements.
11. Cancellation, expiry, and refunds
Cancel through Apple or Google. Cancellation normally leaves access through the store-verified paid-through date; grace, hold, pause, expiry, refund, chargeback, and revocation follow the store-confirmed state. Expiry locks Premium collection access but preserves visits, photos, saves, and progress. Refund decisions are managed by the applicable store under its rules.
12. Account deletion is separate
Deleting the Histrail account does not necessarily cancel an App Store or Google Play subscription. Cancel the subscription separately in the store. Account deletion removes Histrail account data as described in the Privacy Policy, while store transaction records may be detached and retained only under an approved operational/legal schedule.
13. Histrail intellectual property
Histrail branding, software, layouts, curated collection structure, and original editorial work are protected by applicable intellectual-property rights. Third-party historical images, maps, sources, and names remain subject to their own rights, licenses, and attribution.
14. Prohibited use
Do not misuse the API, bypass access controls, scrape in a harmful way, upload malicious or unlawful content, interfere with the service, impersonate others, expose private share tokens, or use Histrail to trespass, endanger people, or damage historical places.
15. Third-party services and availability
Maps, identity providers, app stores, external sources, venues, and other services have their own terms and availability. Histrail may change, suspend, or discontinue parts of the service for editorial, safety, technical, or legal reasons. Offline behavior is limited and live maps, purchases, restoration, and server-backed features require connectivity.
16. Termination
You may stop using Histrail and delete your account. Histrail may suspend or terminate access for material abuse, unlawful activity, security threats, or repeated violation of these Terms. Provisions that by their nature should survive termination remain in effect, including ownership, disclaimers, and applicable limitations of liability.
17. Disclaimers, liability, disputes, and contact
Histrail is provided on an “as available” basis. To the maximum extent permitted by applicable law, Histrail does not guarantee uninterrupted availability, error-free operation, or the completeness of historical, venue, map, or third-party information. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded. To the maximum extent permitted by law, Histrail is not responsible for indirect or consequential loss arising from use of the service or a decision to visit a place. These Terms are governed by the laws of Ukraine, without limiting mandatory consumer protections that apply where you live. If one provision is unenforceable, the remaining provisions continue to apply. Questions about these Terms may be sent to support@histrail.app.
